2023年5月19日，美国财政部金融犯罪执法网络（FinCEN）和美国商务部产业安全局（BIS）发布新的补充警示，旨在进一步限制和阻止俄罗斯获得所需的技术和货物，以供应和补充其军事和国防工业基地。本次警示进一步详细说明了逃避制裁的类型，为金融机构强调了九个高优先级协调制度（HS）代码，以告知其客户尽职调查，并确定了额外的交易和行为危险信号，以帮助金融机构识别与可能的逃避出口管制有关的可疑交易。

一、9个高优先级HS税号（EAR746附件7中，高优先级物品清单主要基于在乌克兰战场上回收的俄罗斯武器系统部件的HS代码分类。这些HS代码所描述的物品已在用于打击乌克兰的多个俄罗斯武器系统中发现，包括Kalibr巡航导弹、Kh-101巡航导弹、，以及奥兰-10无人机Orlan-10 UAV）

1、8542.31 Electronic integrated circuits: Processors and controllers, such as microcontrollers （集成电路：处理器和控制器，如微控制器）

2、8542.32 Electronic integrated circuits: Memories, such as SRAM（集成电路：存储器，如SRAM）

3、 8542.33 Electronic integrated circuits: Amplifiers, such as op amps （集成电路：放大器，如运算放大器）

6、 8526.91 Radio navigational aid apparatus, such as GNSS modules （无线电导航辅助设备，如全球导航卫星系统模块）

9、8548.00 Electrical parts of machinery or apparatus, not specified or included elsewhere, such as EMI filters （其他地方未规定或未包括的机械或设备的电气部件，如EMI滤波器）

二、对以上9个税号贸易性金融的审查建议（非GECC国家，GECC国家包括 Iceland, Liechtenstein, Norway, Switzerland, Australia, Canada, the 27 member states of the European Union (EU), Japan, the Republic of Korea, Taiwan, New Zealand, the United States, and the United Kingdom ）

1、The company never received exports prior to February 24, 2022;（该公司在2022年2月24日之前从未收到出口）

2、The company received exports that did not include any of the nine HS Codes prior to February 24, 2022; or（该公司在2022年2月24日之前收到的出口不包括九个HS代码中的任何一个）

3、 The company received exports involving the nine HS Codes prior to February 24, 2022, but also saw a significant spike in exports thereafter. （该公司在2022年2月24日之前收到了涉及九个HS代码的出口，但此后出口也大幅飙升）

三、对以上9个税号的金融公司尽职调查建议（非GECC国家）

1、Evaluating the customer’s date of incorporation (e.g., incorporation after February 24, 2022)（评估客户的注册日期（例如，2022年2月24日之后的注册日期））

2、Evaluating the end user and end use of the item (e.g., whether the customer’s line of business is consistent with the ordered items), and（评估物项的最终用户和最终用途（例如，客户的业务线是否与订购的物品一致））

3、Evaluating whether the customer’s physical location and public-facing website raise any red flags (e.g., business address is a residence, no website is available). （评估客户的实际地址和面向公众的网站是否会引发任何危险信号（例如，营业地址是住所，没有可用的网站））

四、新的红旗警示（Red Flags）

1、Transactions related to payments for defense or dual-use products from a company incorporated after February 24, 2022, and based in a non-GECC country（与2022年2月24日之后成立、总部位于非GECC国家的公司的国防或军民两用产品付款有关的交易）

2、A new customer whose line of business is in trade of products associated with the nine HS codes, is based in a non-GECC country, and was incorporated after February 24, 2022（一位新客户的业务线是与九个HS代码相关的产品贸易，总部位于非GECC国家，于2022年2月24日后注册成立）

3、An existing customer who did not receive exports associated with the nine HS codes prior to February 24, 2022, but who is receiving such items now.（一位在2022年2月24日之前没有收到与九个HS代码相关的出口，但现在正在收到此类物品的现有客户）

4An existing customer, based outside the United States, received exports associated with one or more of the nine HS codes prior to February 24, 2022, and requested or received a significant increase in exports with those same codes thereafter. （一家总部位于美国境外的现有客户在2022年2月24日之前收到了与九个HS代码中的一个或多个相关的出口，并在此后请求或收到了与这些相同代码相关的出口大幅增加）
